1. Acceptance of Terms

By downloading, installing, or using the StudyPace application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We recommend reading these Terms carefully before using StudyPace.

These Terms constitute a legally binding agreement between you and StudyPace ("Company", "we", "us", or "our") regarding your use of the Service. If you are under 18 years of age, you must obtain parental or guardian consent before using StudyPace.

2. License to Use

We grant you a non-exclusive, non-transferable, revocable license to download and use StudyPace solely for your personal, non-commercial educational purposes. This license does not permit you to:

• Modify or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove or obscure any proprietary notices or labels
• Use the Service for any commercial purpose
• Use the Service to develop competing products
• Rent, lease, lend, or sell access to the Service
• Frame or mirror the Service on other websites

3. User Content

"User Content" includes any images, text, data, or other content you upload, submit, or share through StudyPace, including photographs of homework questions.

Your Rights & Responsibilities

• You retain all rights to your User Content
• You are solely responsible for your User Content
• You represent and warrant that you own or have rights to your User Content
• You agree not to upload copyrighted educational materials without permission
• You agree not to violate any third-party rights

Our Rights to User Content

By submitting User Content to StudyPace, you grant us a worldwide, non-exclusive, royalty-free license to:

• Process and analyze your content to provide the Service
• Improve our AI models and algorithms
• Store backups of your content
• Display your content within the Service

We will delete your User Content when you request account deletion, subject to legal retention requirements.

4. Prohibited Activities

You agree not to:

• Use StudyPace for any illegal purpose or in violation of applicable laws
• Upload content that is defamatory, abusive, obscene, or hateful
• Attempt to gain unauthorized access to StudyPace systems
• Interfere with or disrupt the Service or servers
• Use automated tools or bots to access or scrape the Service
• Circumvent security measures or access controls
• Harass, threaten, or abuse other users
• Engage in any form of cheating or academic dishonesty
• Violate the intellectual property rights of others
• Engage in any conduct that could damage StudyPace's reputation

5. Intellectual Property Rights

StudyPace and all of its contents, features, and functionality (including but not limited to all information, software, text, images, graphics, and logos) are owned by StudyPace, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

Our AI models, algorithms, and educational content are proprietary and subject to copyright protection. You may not reproduce, distribute, or transmit any of this content without our prior written permission.

6. Subscriptions & Payments

Subscription Plans

StudyPace offers three subscription tiers:

• Free (Starter): 5 problems per month
• Premium: 70 problems per month
• Pro: Unlimited problems

Billing & Charges

• Subscription fees are charged in advance on a monthly basis
• Charges will appear on your device's app store billing (App Store or Google Play)
• We do not collect credit card information directly
• All prices are in USD unless otherwise specified

Auto-Renewal

Your subscription will automatically renew each month unless you cancel before the renewal date. You understand and agree to the recurring charge. Cancellation instructions are available in your device's app store settings.

Refund Policy

• New subscribers receive a 7-day refund period for their first subscription
• Refund requests must be submitted within 7 days of purchase
• Refunds are processed through your app store
• After 7 days, subscriptions are non-refundable

Free Trial

StudyPace may occasionally offer free trial periods. Free trials auto-convert to paid subscriptions unless cancelled before the trial ends. Check your app store for current trial offers.

7. Disclaimers

Educational Purpose Only

StudyPace is designed as an educational aid and homework helper. Solutions and explanations are provided for learning purposes only. We do not encourage cheating or academic dishonesty. Users are responsible for using StudyPace in compliance with their school's or institution's academic integrity policies.

Accuracy of Content

While StudyPace maintains a 99% accuracy rate, we do not guarantee that all solutions are correct. Complex problems or edge cases may produce incorrect results. Users should verify solutions with their teachers, textbooks, or other reliable sources.

No Warranty

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STUDYPACE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE LAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THIS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless StudyPace and its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from or relating to:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any law or third-party right

10. Termination

We may terminate or suspend your account at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Engaging in prohibited activities
• Abuse of the Service
• Non-payment of subscription fees
• Repeated policy violations

Upon termination, your right to use the Service immediately ceases. You remain responsible for any outstanding charges. We may delete your account and associated data after termination.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notice. Your continued use of StudyPace after changes constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.

Additional Legal Provisions

Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to its conflicts of law principles.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StudyPace regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
